Persons who wish to place listings and those who subscribe to receive listings by e-mail are required to register their names,
complete addresses, e-mail addresses, and telephone information (hereinafter referred to as "user information") with the
Web-Based Materials Exchange ("BoneyardNW"). The BoneyardNW does not support spammers, junk e-mail, or junk snail-mailers
by selling e-mail lists, mailing addresses or any other user information.
The BoneyardNW is owned and operated by Metro, the regional government providing services within the greater metropolitan
region of Portland, Oregon. As an Oregon public body, the Oregon Public Records Law, ORS 192.410 through 192.505, applies to
Metro's public records. As described in this policy, the BoneyardNW believes that user information is exempt from disclosure
under the Public Records Law. BoneyardNW therefore will not disclose user information to any person or outside organization
unless required to do so by order of the Multnomah County District Attorney.
Some users may treat their own user information as confidential. For example, they may choose to use an alias when they
post a listing to the BoneyardNW, they may choose not to list their phone number in the telephone directory, and they may
not permit their e-mail address to be freely available to the public. The user information for such users shall be considered
confidential (hereinafter referred to as "confidential user information").
Confidential user information should reasonably be considered confidential, will be submitted to the BoneyardNW in confidence,
and is not otherwise required by law to be submitted. The BoneyardNW site administrator/operator obliges itself in good faith
not to disclose confidential user information. If confidential user information were not exempt from disclosure under the
Public Records Law the public interest would suffer because fewer persons would be willing to participate in this exchange.
As described in this paragraph, confidential user information therefore meets all of the requirements to be exempt from
disclosure under the Oregon Public Records Law pursuant to ORS 192.502(4). User information is also exempt from disclosure
to the extent it constitutes trade secrets pursuant to ORS 192.501(2).
Registered users of the BoneyardNW are informed that they have the option to receive e-mail confirmation messages from the
BoneyardNW when their listings are placed online or updated by the site administrator. A second message will be automatically
generated prior to the listing's expiration date. Registered users may also sign up for automatic e-mail updates to provide them
with notice of material listings that reference materials in which they have indicated an interest.
Users who sign up to receive listings by e-mail do so on a voluntary registration basis, meaning that the user submits his or her
e-mail address (and other information) and requests the service.
Several steps are taken to ensure that a user cannot be unknowingly signed up for a service that he or she does not wish to receive.
We discourage misuse/abuse of sign-up forms by (a) recording the internet provider address of any computer submitting a sign-up
form, and (b) requiring that the user enter a password which is sent to the e-mail address in question before actually activating
the account.
Users who sign up to receive listings by e-mail can cancel the service at any time. Cancellation instructions will be indicated
in each message.
Despite this Privacy Policy, it is possible that the BoneyardNW may accidentally release user information or that a court may
order the BoneyardNW to release user information. By using this site, you agree (a) that you will not bring any suit, claim,
or cause of action against the BoneyardNW, Metro, or Metro's officers and employees for any damages resulting from any release
of user information and (b) to absolve the BoneyardNW, Metro, and Metro's officers and employees of any liability resulting
from the release of user information, regardless of the manner in which user information was released and the
consequences of the release.
